We often receive the question, "Is the AI Interview Companion categorized as a High-risk AI system under the EU AI Act?". The answer is no, and this article explains why.

The EU AI Act states:
High-risk AI systems are those under Annex III use cases (below), except if:
- The AI system performs a narrow procedural task;
- Improves the result of a previously completed human activity;
- Detects decision-making patterns or deviations from prior decision-making patterns and is not meant to replace or influence the previously completed human assessment without proper human review;
- Performs a preparatory task for an assessment relevant for the purpose of the use cases listed in Annex III.
When classifying the AI Interview Companion product in the category of using AI in recruiting, the Act carves out explicit exceptions for the things that the AI Interview Companion is doing:
- The AI Interview Companion uses of AI is narrow
- The AI Interview Companion improves the result of hiring teams to be fairer
- The AI Interview Companion is not meant to replace a human assessment
- The AI Interview Companion performs a task that prepares interviewers (humans!) to assess the candidates themselves
Because of this, the AI Interview Companion considers the system not to be in the High-risk category as defined by the exceptions provided in the EU AI Act.
